Phione is not a legendary Pokemon. Along with Rotom and Spiritomb.

You can get as many of them as you want from breeding, Phione itself can be bred for more Phione (which is something no legendary can do, and breeding with Manaphy doesn't give you another Manaphy), and in the main games you never capture it in traditional legendary style (talking to it in the overworld, catching it like you do Cresselia, special movie distribution, or anything like that).

While it may being the offspring of a legendary and part of the Sea Guardians, it's stats are subpart for a legendary, and I really don't see what it represent's that Manaphy doesn't already. Additionally it's too easy to get to really amount to being a legendary which are generally considered rare.

I like to think of it this way:

When a legendary man/woman has a child, is that child considered to be legendary?

Phione is only half a legendary. So no, it's not.

I get why people would argue for Rotom, but why Phione? Just because it comes from a legendary doesn't make it one.

It's definitely confirmed that Phione isn't legendary, along with Rotom and Spiritomb. Since Manaphy is mythical, a legendary coming from a mythical would totally not make sense. There is debate about whether or not Phione mythical, though, but I don't believe it is.

My friend's Pokémon book says that Kadabra is posion/flying.
And as many have stated, it is confirmed NOT legendary.

Phione is a part of the Sea Guardians, a Legendary Duo. It has many caracteristics that make it more common than any other, but, in my oppinion, it's a Legendary Pokemon.

I guess I more consider it to be an legendary offspring, like half-gods in mythology :D but the fact that it's part of a duo also states it's legendary status.

Phione is not found in any regional Pokédex, a trait that is otherwise exclusive to Generation IV Legendary and Mythical Pokémon.
In Pokémon Rumble Blast, Phione can only be unlocked once a certain number of customers have shopped at the Toy Shop, a trait otherwise exclusive to Legendary and Mythical Pokémon.
Phione was featured in Pokémon.com's 2012 Pokémon Power Bracket, a single-elimination tournament where all other Pokémon in the bracket were Legendary and Mythical Pokémon.
Phione was a usable Pokémon in the Circle of Legends tournament, in which only Legendary and Mythical Pokémon were allowed.

Evidence against
Phione can breed to produce another Phione; this is impossible with any other Legendary and Mythical Pokémon. However, Manaphy can also breed to produce Phione, and Manaphy is a confirmed Mythical Pokémon.
Pokémon HeartGold and SoulSilver: Prima's Official Strategy Guide states that Phione is not Legendary, due to it being able to be obtained by hatching Eggs.
In Pokémon Ranger: Guardian Signs, all Legendary Pokémon are referred to as Legendary, and all Mythical Pokémon are referred to as "rare," but Phione is referred to as neither. It is also found normally in the wild.

Other
Pokémon.com's mailbag was once asked if Phione was Legendary. The official answer was initially no, but was quickly changed to yes;

I think it is a MYTHICAL, because it's descended from Manaphy, which to my knowledge has always been an event Pokémon, and therefore a mythical, making Phione a mythical, but not a legendary
